  • com is an online store, and a “customer” is someone who utilises the online store and delivery service.
  • Products ordered by customers are referred to as “goods” or “products.”
  • All of the sweets and nibbles are perishable.
  • All products that are not perishable are considered non-perishable goods.
  • Products: In most cases, the products delivered to the recipient will match the article description and the image chosen by the buyer.

 

Life of the Product

  • Halwai sweets and snacks must be consumed within three days of purchase.
  • Ghee sweets should be consumed within 7 days of purchase and should not be kept in the refrigerator.
  • You must consume Mava Sweets within three days of purchase.
  • Dry Fruit Sweets (Kaju) must be consumed within seven days of purchase.
  • Store Milk Base Sweets in the refrigerator and eat them within two days of purchase.
  • Bengali sweets must be kept in the refrigerator and eaten within eight hours of purchase.

 

The Contract Between Us

  • We will confirm that your order has been approved by sending you an email at the address you supplied on your order form once we have received full payment for the products (checkout page). When we accept your order, we enter into a legally binding agreement.
  • If the products are no longer available or if we have made a pricing error, we will contact you.
  • The sender is bound by our terms and conditions once the order is placed. Only if the sender agrees to our terms can he or she place an order with Halwai Sweets and Snacks.
  • Orders for cash on delivery are also accepted.

 

General

  • When you place an order for a product in any of the ways listed above (“order”), you are making an offer to buy it for the price listed, subject to these Terms.
  • When you place an order online, we will send you an email to confirm receipt. This email confirmation will be automatically sent to you so that you may double-check the details of your order. The receipt of an automatic confirmation does not imply that your order will be completed. We’ll check availability and send you a follow-up email after we’ve sent the confirmation email.
  • This email will be regarded an acceptance if the product is available and the order data is correct, and it will include delivery details as well as the price.

 

Price

  • You can find the prices for the items you order on our website and in our catalogue.
  • GST is included in the prices stated on our website for each product.

Although we make every attempt to guarantee that the pricing is right, mistakes do occur.

  • If we detect a pricing error in your order’s products, we will contact you as soon as possible using the contact information you provide.
  • At that point, you’ll have the option of reconfirming or cancelling your order at the correct price. (Your order will be cancelled if we are unable to contact you.)
  • If an order is cancelled, any money paid for the products will be refunded in full.
  • Once items have been delivered, they cannot be returned.
  • Before you submit your payment information, you will be notified of the delivery rates based on the quantity of your order and the delivery address you specify.
  • Halwai Sweets and Snacks website prices are in INR (Indian Rupees) – if you are outside of India, your payment gateway should translate the amount charged to your country’s currency at the current rate.
  • Please keep in mind that all charges and refunds are in Indian rupees, and we are not responsible for any losses suffered due to currency rate fluctuations.
  • Please bear in mind that if an order is cancelled in any status in a foreign/abroad transaction, the refund/remittance should only be dependant on bank or financial institution acceptance.

 

Payment

  • Internet prices are more than the MRP on the mithai or namkeen box. The mithai and namkeen boxes’ MRPs are for in-person collection at the mithai shop. Other costs, such as shipping, packaging, and taxes, are included in the Halwai Sweets and Snacks website pricing. The buyer agrees to pay the amount mentioned on the website and/or on the invoice given by Halwai Sweets and Snacks by accepting these terms and conditions. After an order has been placed, Halwai Sweets and Snacks will not accept any complaints in any court of law as a result of a price paid that is more than the MRP at the shop.
  • We must receive full payment before we can dispatch your purchase.
  • We accept credit cards, debit cards, cheques, and credit card information can also be given over the phone.

 

Changes in Services and Prices

  • We have the right to change or cancel the Service (or any aspect or content of it) at any time and without notice.
  • We will not be liable to you or any third party for any modification, pricing change, suspension, or discontinuance of the Service.

 

Our Products & Services

  • We have made every effort to accurately reflect the colours and images of our products that appear in the store.
  • We cannot guarantee that the colour displayed on your computer monitor will be accurate or that the resolution of our devices will match.
  • The products on display are only for demonstration reasons. The accessories displayed are not included in the package unless otherwise noted. The exact order of any current products will vary due to the variability of contents across distinct destinations.
  • We reserve the right, but not the duty, to limit the sale of our products or services to any individual, geographic location, or jurisdiction, and we may do so on a case-by-case basis.
  • All product descriptions and pricing are subject to change at our sole discretion at any time without notice, and we reserve the right to withdraw any product at any time.
  • Any product or service offer made on this site is void where prohibited.

Availability

  • We make every attempt to maintain a large inventory of products. However, because to the large number of sweets we sell, a product listed may be out of stock at any time. If we are unable to provide a product ordered, we reserve the right to replace equivalent goods (or as close as possible). We may offer to deliver the product to you as a back order as soon as it becomes available. If you agree to wait, you have the option of waiting or obtaining a refund for the out of stock item.
  • While we make every effort to keep Halwai Sweets and Snacks up to date, we cannot guarantee that specific products will always be available due to the nature and limited availability of the fast-selling/famous sweets we sell.
  • We may also offer you the option of having the product shipped as a back order (with the remainder of your purchase shipped as soon as the product becomes available) or refunding or re-crediting your account with the actual amount deposited to our account if we are unable to deliver a product.
  • All discounts are only available for a short time.
  • If we are unable to offer a product you have requested, we will notify you as soon as possible after receiving your order. If this happens, you can cancel your order and get a refund for your money.

 

Corporate Orders

  • All orders must be paid in full prior to shipping.
  • All required artwork must be sent at least 20 days ahead to the projected delivery date of the product.
  • We require your permission to use your artwork and branding.

 

Changes to Terms & Services

  • We reserve the right, at our sole discretion, to update, alter, or replace any element of these Terms of Service by making changes and updates to our website.
  • It is your responsibility to check our website for updates on a regular basis; your continuing use of or access to our website or the Service following the publication of any changes to these Terms of Service signifies your acceptance of such changes.

Liability

  • If the items you received are not what you ordered, are damaged, or are the wrong quantity, please let us know. We’ll then make the necessary adjustments to your order. Consider the case below:
  • Fill any gaps or non-delivery items.
  • Any defective items will be replaced, and substitute goods must be supplied and delivered.
  • We may offer a full or partial refund at our discretion.
  • Please bear in mind that we are not responsible for any postage-related damage, such as the effects of weather on the product. We double-check everything before sending it to you to make sure it’s in perfect condition. If your package arrives damaged, please let us know.
  • We shall not be liable for any indirect or consequential loss, damage, or expenses that you may experience (including loss of profits, business or goodwill). Except for a return of the price you paid for the products in question, we will not be liable to pay you any money as compensation.
  • We make no guarantees or representations about the accuracy, timeliness, performance, completeness, or suitability for any purpose of the information and materials found or offered on this website. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly disclaim liability for any such inaccuracies or mistakes to the fullest extent permitted by law.   • Events beyond our control: If the failure or delay is caused by an occurrence or circumstance beyond our reasonable control, we will not be liable for any failure to deliver products you have purchased, any delays in doing so, or any damage or defect to products provided. Strikes, lockouts, and other labour disputes, system or network access problems, flood, fire, explosion, or accident are only a few instances.
  • We will not be liable for any direct or indirect loss, damage, or delay caused by an erroneous address, an act of God, such as accidents, natural calamities, war, riot, disturbance, strike, Local/Political Disruptions, Air / Rail / Road Disruptions / Delays, or any other cause beyond our control. We will not take any payments in such instances.
  • If the consignee refuses to provide proper acknowledgement, such as a signature, company seal, date and time of delivery, Halwai Sweets and Snacks reserves the right to refuse delivery of any consignment ordered by the Customer, and we will not be liable for any consequences or losses resulting from such non-delivery. No packages will be delivered to a post office box. Furthermore, we will not provide evidence of delivery for consignments delivered to Governmental / Semi-Governmental offices.
  • The Customer agrees to reimburse Halwai Sweets and Snacks on demand for any Octroi/Entry Tax, Sales Tax, and Airport/Railway Station costs paid by Halwai Sweets and Snacks. For any consignment booked by the Customer, Demurrage Charges, or any Penalty associated with any of the aforementioned, or for failure to submit various government forms / road permits, or other government levies. • All delivery records and other associated documents are subject to destruction by Halwai Sweets & Snacks after 90 days. • The Customer is bound by all of the logistics partner’s terms and conditions mentioned on the overleaf of the consignment note.
  • The customer agrees with Halwai Sweets and Snacks that no other person with an interest in the consignment may bring a claim or action against us arising from the carriage, even if we are negligent or in default, and that if a claim or action is brought, the customer will indemnify us against the claim or action’s consequences, as well as the cost and expenses we incur in defending it.

 

Disputes

  • Any dispute or claim resulting from your use of any Halwai Sweets and Snacks products or services, or any other products or services sold or supplied by Halwai Sweets and Snacks or through www.Halwaisweets.com, will be decided solely in Surat (India).
  • We each agree that any dispute resolution activities will be performed individually, rather than as part of a class, consolidated, or representative action.

  • Halwai Sweets and Snacks does not provide you any copyright or intellectual property rights in any of its products, nor does it allow you to copy them.
  • Unless otherwise stated, the copyright of our website, as well as the content of all software, sites, and pages related to Halwai Sweets and Snacks, is owned or licenced by Halwai Sweets and Snacks and may not be used, duplicated, or altered without our express permission.
